Welcome to Outstanda, an Ohio nonprofit corporation organized under Section 501(c)(3) of the Internal Revenue Code. These Terms of Use (“Terms”) govern your access to and use of the Outstanda website, platform, tools, and services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

1. PURPOSE OF OUTSTANDA

Outstanda is a mastery-based and project-based learning system designed to improve academic performance, strengthen foundational skills, and increase the likelihood of early graduation, early college readiness, or early career training opportunities.

Outstanda is a performance engine, not a traditional curriculum provider. Students progress by demonstrating mastery of defined academic skills.

The recommended structure is approximately two (2) hours per day of focused core mastery work. Individual pacing may vary.

Outstanda does not grant degrees, replace accredited institutions, or confer official diplomas.

2. ACCOUNTS

A. Individual Accounts

Each account represents one real individual and may not be shared.

Users must provide accurate information when creating an account. Legal name may be required for official learning records. Parents may request anonymized reporting where permitted.

You are responsible for maintaining the confidentiality of your login credentials.

Outstanda may suspend or terminate accounts for violation of these Terms or misuse of the Platform.

B. Students

Students progress by mastering defined skills and completing Learning Gigs. Mastery requires successful completion of assessments.

Academic integrity is required. Cheating, impersonation, or unauthorized access may result in permanent removal from the Platform.

Students may work at their own pace. Completion timelines vary by individual.

Outstanda provides instructional content and assessments but does not guarantee specific academic outcomes.

C. Parents and Guardians

Parents or guardians may:

Review student progress
Request data corrections
Request anonymized reporting
Request account closure

For students under 13, accounts must be authorized by a parent, guardian, or school as required by law.

D. Educators and Organizations

Schools, homeschool groups, and educational organizations may use Outstanda to support student learning.

Organizations are responsible for:

Verifying student enrollment
Supervising project-based components where applicable
Ensuring lawful use of student data

Outstanda does not replace institutional academic standards or accreditation requirements.

3. PLATFORM STRUCTURE

Outstanda delivers:

Atomic skill mastery modules
Learning Gigs (grouped skills)
Retention assessments
Growth tracking in literacy, math, and logic
Project-based learning components where appropriate

Mastery requires successful assessment completion.

Some features may include internal game-based credits for engagement. These credits have no cash value and are not financial instruments.

4. DATA AND PRIVACY

Outstanda collects only the minimum data necessary to:

Create accounts
Maintain learning records
Track mastery and growth
Provide reports to authorized users

We do not sell, lease, or monetize student personal data.

Artificial intelligence tools may assist with grading and instructional support. No personally identifiable student information is transmitted to AI systems. Only limited contextual information such as grade level or age range may be processed.

Use of the Platform is also governed by our Privacy Policy.

5. ACADEMIC CONTENT

All instructional materials, text, graphics, and platform design are the property of Outstanda unless otherwise noted.

Content may not be reproduced, distributed, or used for commercial purposes without written permission.

Some materials may incorporate third-party content subject to their respective licenses.

Educational materials are provided for instructional purposes only and are not guaranteed to be comprehensive.

6. DISCLAIMERS

The Platform is provided “AS IS” and “AS AVAILABLE.”

Outstanda makes no guarantees regarding:

Academic advancement
Graduation timelines
College admission
Employment outcomes

We do not guarantee uninterrupted access to the Platform.

We are not liable for:

Temporary service interruptions
Technical errors
Loss of data due to user actions
Unauthorized access beyond reasonable safeguards

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Outstanda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

Your use of the Platform is at your own risk.

8. USER CONDUCT

Users may not:

Share accounts
Attempt unauthorized access
Interfere with system functionality
Post unlawful, harmful, or abusive content
Misrepresent identity

Outstanda reserves the right to investigate misuse and cooperate with lawful authorities when required.

9. THIRD-PARTY LINKS

The Platform may include links to external resources. Outstanda does not control and is not responsible for third-party content.

10. ARBITRATION AND GOVERNING LAW

Any disputes arising from use of the Platform shall be resolved through binding arbitration in the State of Ohio in accordance with the rules of the American Arbitration Association.

These Terms are governed by the laws of the State of Ohio and applicable United States federal law.

11. GENERAL PROVISIONS

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

Failure to enforce any provision does not constitute waiver.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Outstanda regarding use of the Platform.
